Privacy Policy

References to “we”, “our” or “us” in this policy means Endless Holdings Limited trading as Endless Metals / Endless, its successors, agents, employees and assignees and references to “you” means any person, firm, company or body which interacts with us.

By using or accessing our website and/or any of our services, or by providing any personal information (directly, through our website or otherwise), you will be deemed to have agreed to be bound by this privacy policy.

Introduction

We appreciate that by you providing your personal information via our website, you have placed your trust in us. We don’t take this lightly and that’s why we have the necessary measures in place to protect the privacy of your personal information.

When we collect your personal information, we will comply with the privacy laws of New Zealand, including in particular the Privacy Act 2020 (“Privacy Act”) and the 13 privacy principles, and the Secondhand Dealers and Pawnbrokers Act 2004 (“Secondhand Act”).

We will always do what we reasonably can to be open and transparent about the ways we collect, store and use your information and we invite you to shout out if there is anything you’d like to know.

Some legal stuff

This privacy policy only applies to living, breathing people.  It doesn’t apply to non-humans like companies, even though companies are made up of humans.  That being said, we’ll still endeavour to apply the same high standards to protect information relating to non-humans.

We comply with the Privacy Act because firstly, it’s the law and secondly, it’s the right thing to do when you’ve trusted us with your personal information.  We take our responsibility to you very seriously.

What’s covered under personal information

Generally, the type of personal information we collect will include your name, email, address, location and contact information. We may collect certain additional personal information as may be required by the Secondhand Act.

We may also capture IP details and “cookies” when you use our website.

Why we need your personal information

We need your personal information so we can efficiently and effectively carry out the services we offer to you, or to comply with our statutory obligations. This will generally include:

  • To deal with your enquiries and requests;
  • To create and maintain a relationship with you as a customer;
  • To efficiently provide you with products and services;
  • To improve the products and services that we provide to you; and
  • To keep you updated and informed about the products and services we offer.

We are required by the Secondhand Act, to keep a record of the identity and some of the personal information of every person we buy scrap metal from.

We will also need your personal information if you have opted in to receive marketing communications from us to enable us to send you the relevant information you signed up to receive either via text message or email.

Changes to this policy

We may need to update or change this policy from time to time.  If we do, we’ll upload a revised policy onto our website.  The change will apply from the date that we upload the revised policy.

We suggest that you check our website regularly for any changes to this privacy policy.

Who do we collect your personal information from

We collect personal information about you from:

  • you, when you provide that personal information to us, through the website or when you sign up for a service with us.  We may also collect it from you on the phone or via email or through our social media platforms.
  • third parties where you have authorised this,
  • publicly available sources. 

We’ll try however, to always collect the information from you directly, so that you know we have it.

You are not obliged to provide us with your personal information, however without it, we could be restricted both in what services we can offer to you and the quality of the services we can offer.

When we use your personal information

We will only use and disclose your personal information for the purposes for which it was collected (or otherwise as required or authorized by law). Some examples of when we will use your personal information include: 

  • when we’re providing services and products to you
  • when we need to communicate with you electronically
  • when you have signed up to receive marketing communications from us
  • to improve the services and products that we provide to you
  • to make payments to you, to bill you and to receive payments from you, including authorising and processing credit card transactions
  • to reply to communications from you
  • to conduct research

Since this list may become very long if we try to cover every possibility, you should know that there may be other situations when we would need to use your information.  It will always be in line with what is permitted and acceptable in terms of the Privacy Act.

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements (or as otherwise required by law).

Contacting you for marketing communications

When you sign up to receive marketing communications from us, we’ll reach out to you via text or email based on the choice you made when you signed up.  

You absolutely do not have to agree to receive marketing communications from us to do business with us.

  • If you chose text messages, we’ll send marketing comms to the number you provided when you signed up.
  • Heads up, message frequency might vary.
  • You can stop receiving text messages from us at any time by replying STOP to a text. This will opt you out.
  • If you have questions or need any help, reply HELP to a text and we’ll be on it in two shakes of a lamb’s tail.
  • If you text us, please be aware that you’ll be charged your mobile provider’s standard text message rates and these vary from provider to provider.

  • If you chose email, we’ll send marketing comms to the email address you provided when you signed up.
  • Email frequency may vary.
  • You can stop receiving emails from us at any time, by clicking UNSUBSCRIBE in the footer of our email. This will opt you out or email marketing communications.

    If you would like to change your preferences at any time or you would no longer like to receive communications from us, simply click “Update preferences” in the footer of our email, call 0800 44 88 99 or email hello@endless.co.nz

We are committed to full compliance with the Unsolicited Electronic Messages Act 2007.

Disclosing your personal information

There may be times when we need to disclose your personal information to third parties and some examples of this would include supplying information to:  

  • another company within our group
  • a business that supports our services and products, like our IT company who maintain and host our underlying IT systems and data
  • a credit reference agency if you have agreed to a credit check by us
  • other third parties (for anonymised statistical information)
  • a person/entity who can demand that we supply your personal information (e.g. a regulatory authority)
  • any other person or entity authorised by law
  • any other person or entity authorised by you.

There may be a possibility that one of the above is located outside New Zealand which means that your personal information may be held and processed outside the country.

We will never sell, exchange or release your personal information for commercial gain.

Protecting your personal information

We promise to take all humanly reasonable steps to keep your information safe from loss, unauthorised activity, or any other misuse or abuse.

Accessing and correcting your personal information

If you’d like for your personal information to be corrected, erased or otherwise destroyed, you have the right to access the readily retrievable personal information that we hold.  The Privacy Act does set out some situations where we would have to refuse this request.  We’d also need to make 100% sure that you are who you say you are and confirm your identity before we can share the information. (this protects you too)

Internet use

We can’t live without the internet and we all use it and even though we take all reasonable steps to keep secure connections, there will always be risk when sharing details online so please be aware that providing your personal information over the internet is at your own risk.

If you do follow a link on our website to another site, the owner of that site will have their own privacy policy relating to your personal information, so we’d recommend that you take the time to review their privacy policy too, before you share your information.
